Mucho General Terms and Conditons
As of 1st Decembrer 2009


The present general terms and conditions govern the mobile whole of the prepaid telephone services provided by BeeOne Communication SA. The current version of these General terms and condition is available permanently on at www.mobileverymucho.ch. The French version is used as reference in the event of conflict of translation or interpretation.

BeeOne Communication SA will hereafter be referred by the registered trade mark Mucho. The term of ?Customer? is used to designate any person who contracts with Mucho by registering a chart SIM Mucho.

Mucho provides mobile telephone services such as those defined at www.mobileverymucho.ch. For that, Mucho calls upon third parties which contribute to the execution of its contractual obligations. Mucho cannot guarantee to the Customer a complete absence of disturbances and dysfunctions.

In accordance with the law, the access to the Mucho services requires a preliminary registration of the Customer. The Customer is thus held to present official proof of identity. If it is not possible to check the identity of the Customer and pursuant to article 15 subparagraph 5bis of the federal law on the monitoring of the correspondence by station and telecommunication (LSCPT), the Mucho SIM card cannot be sold. The known General terms and conditions are accepted by the Customer when he/she registers.

The Customer must promptly inform Mucho of any change of address. The Customer must promptly report to Mucho in the event of a lost or stolen SIM card/ and or the secret data associated (PIN, PUK?). In the event of a request by competent authorities, the name and the address of the purchaser are released, even in the event of transfer of a Mucho SIM card. If the person to whom the card is yielded makes criminal acts by using the card, the purchaser can be penally prosecuted for complicity, participation or obstruction with the criminal proceedings.

Mucho SIM cards are sold to the Customer with an initial monetary credit determined by Mucho, whose amount and expiration date can vary according to the date and place of registering the SIM card.

The customer can then recharge his prepaid account according to the methods described at www.mobileverymucho.ch. The monetary credit and the fixed price airtime have a permanent expiration date clearly communicated to the Customer. This expiration date is redefined with each recharge of the account according to the type of recharge. Each recharge clearly indicates the period of validity of the credit and the fixed price airtime possibly included. The exact date and hour of expiry of the credit and the fixed price airtime are confirmed to the customer with the activation of his recharge.
On the expiration date of fixed price airtime, the residual minutes are lost; they are neither refundable nor transferable. However, the Customer can still telephone if the card holds monetary credit. On the expiration date of the monetary credit, the residual credit is lost; it is neither refundable nor transferable. When an account has no more monetary credit or fixed price airtime, it is still possible to receive calls for 30 days. Then SIM card cannot be used any more unless it is recharged. After 6 months without use, SIM card loses any validity and cannot be recharged. The contract is terminated. The phone number associated with the account is then reassigned to a new SIM card, thus, the card cannot be recovered by the Customer. To determine the monetary credit and the serviceable fixed price airtimes on the prepaid account, as with their respective expiration date, only the meters of the system of calculation Swisscom, supplier of the service for Mucho, are used.

Certain Mucho recharges include a participation in a contest with no purchase necessary, Mucho Bingo, whose rules and regulations are available at www.mobileverymucho.ch.

Current rates for Mucho services are available at www.mobileverymucho.ch. Mucho reserves the right to modify them at any time. Customer use of the services after publication of new tariffs is subject to the new prices.

For technical reasons, in case of necessary exploitation or following lawful obligations, the call numbers can be withdrawn or modified without compensation.

Customer data is handled by Mucho in accordance with the current legislation. Mucho collects, stores and uses only the data necessary for the legal regulations of the application, necessary to supply the services, and useful for the establishment and the maintenance of a good relationship with the Customer. Mucho collaborates moreover with third party companies, in Switzerland or abroad; Mucho transmits Customer data so that the third party companies handle Mucho customers accordingly with their Mucho account. The Customer gives Mucho the right to use his/her data in order to conceive and improve services for the Customer. He/she authorizes also a priori Mucho to contact him/her via SMS, telephone, email or postal address to inform him/her on the Mucho services. The Customer can however ask Mucho by postal address to unsubscribe from receiving such information and requests: case postale 1528,1211 Geneva 26.

The Customer must use the Mucho services in accordance with the current General terms and conditions, with the user guides and with the Swiss law. The resale of the Mucho services is prohibited unless there is a specific contract signed between Mucho and the Customer. The use of Mucho accounts to finish calls not originating from a Mucho SIM card (SIM gateway or telephone center), as well as machine-machine calls are strictly prohibited. In the event of suspicion of use not in conformity by the Customer, Mucho reserves the right to suspend, without notice, the account and to terminate the contract binding Mucho to the Customer.

In no case can Mucho be held responsible for an abusive use of its services and the subsequent consequences. In particular, but not exclusively, if the Customer uses his/her account so that he/she violates the Third Party intellectual property laws, he/she must answer himself/herself for his/her acts and relieve Mucho of any condemnation.

For the duration of the contract, the Customer has the nontransferable and nonexclusive right to use the services and the products placed at disposal by Mucho in accordance with the current General terms and with the other contractual arrangements. Mucho - or authorized third parties - preserve all the intellectual property laws existing or resulting from the execution of the contract relative to its services and its products.

Mucho reserves the right to modify the contractual General terms and conditions and other provisions. The Customer will be informed of such modifications at www.mobileverymucho.ch. Customer use of the Mucho services after publication of the new General terms is subject to the new regulations.

Mucho can suspend any of its services at any time. Mucho assumes only the responsibility for damage caused intentionally or resulting from a serious negligence and having consequences on the use of the Mucho services. Any responsibility for shortfall is excluded.

In all the cases, Swiss law is applicable.
